Terms of Service
Last updated: 9 April 2026. Please read these terms carefully — they form a binding agreement between you and DocStow Ltd.
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the DocStow website, web application and related services (the "Service"), operated by DocStow Ltd, a company incorporated in New Zealand ("DocStow", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 16 years old to create a DocStow account. By signing up, you confirm that you are of legal age and have the capacity to enter into a binding contract under New Zealand law.
3. Your account
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately at security@docstow.com if you suspect any unauthorized access. We strongly recommend enabling multi-factor authentication once available.
4. Your content
You retain all ownership rights in the documents, files and information you upload to DocStow ("Your Content"). By uploading Your Content, you grant DocStow a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, back up, encrypt and display Your Content solely for the purpose of providing the Service to you. This licence ends when you delete Your Content or close your account.
You represent and warrant that you have the right to upload Your Content and that it does not infringe any third party's rights or any applicable law.
5. Acceptable use
You agree not to use the Service to:
- Store, share or transmit content that is unlawful, defamatory, harassing, or infringing;
- Upload malware, viruses or any code designed to damage the Service or other users;
- Access, tamper with, or disrupt the Service, other accounts, or any connected systems;
- Attempt to reverse-engineer, decompile or extract the source code of the Service;
- Use the Service to store government-classified material, third-party regulated health data (other than your own family records), or any content that violates applicable export control laws;
- Resell, sublicense or commercially exploit the Service without our written permission.
We may suspend or terminate accounts that violate these rules, with or without notice depending on the severity.
6. Subscriptions and billing
DocStow offers a free tier and paid subscription plans (Family and Premium). Paid plans renew automatically at the end of each billing period unless cancelled beforehand. All fees are quoted in New Zealand Dollars (NZD) and are inclusive of GST where applicable. Payments are processed by Stripe. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
Except where required by the Consumer Guarantees Act 1993 or other mandatory law, fees already paid are non-refundable.
7. Free trial
We may offer a free trial of a paid plan. Unless you cancel before the trial ends, you will be automatically charged for the chosen plan. We will email you before your trial expires.
8. Renewal reminders are not a guarantee
Important: DocStow sends reminders to help you stay on top of renewals for passports, vehicle registrations, insurance policies and similar documents. These reminders are a convenience, not a substitute for your own diligence. You remain solely responsible for meeting legal, financial and regulatory deadlines. DocStow is not liable for any fines, fees, expired documents, missed deadlines or other losses that arise from a missed or delayed reminder.
9. Service availability
We aim to keep the Service running 24/7 but do not guarantee uninterrupted availability. We may temporarily suspend the Service for maintenance, upgrades, security, or reasons beyond our control. We will try to give reasonable notice of scheduled downtime.
10. Consumer Guarantees Act 1993
If you use DocStow as a consumer, you have rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986 that cannot be excluded. Nothing in these Terms limits those rights. If you use DocStow for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available". We make no warranties, express or implied, regarding the Service's fitness for a particular purpose, merchantability, or accuracy of any renewal reminders, AI-extracted metadata, or automated classifications.
12. Limitation of liability
To the maximum extent permitted by law, DocStow's total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) NZD $100, or (b) the total fees you paid to DocStow in the 12 months immediately preceding the event giving rise to the claim. DocStow is not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.
13. Indemnity
You agree to indemnify and hold DocStow harmless from any claim, loss or demand arising out of your breach of these Terms, your misuse of the Service, or Your Content.
14. Termination
You may delete your account at any time from your settings page. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends immediately, but sections that should reasonably survive (payment, indemnity, disclaimers, limitation of liability) will continue to apply.
15. Governing law and jurisdiction
These Terms are governed by the laws of New Zealand. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New Zealand, except where mandatory consumer law provides otherwise.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and post a notice on the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
